The Sale Real Estate Process

  1. Review of Sale and Purchase Agreement

The sale and purchase agreement is a legally binding contract and it is important that you have a lawyer review it thoroughly. We will review your sale and purchase agreement with you and make sure you understand the terms of the agreement, important dates contained in the agreement and any obligations the agreement creates.

  1. Preparation of Legal Documents

When selling your home the buyer’s lawyer will set out a list of things that need to be resolved prior to the closing, these are referred to as requisitions. We will deal with all the necessary requisitions and have them resolved on your behalf in a timely manner so that your closing is not unnecessarily delayed.

  1. Preparing the Deed and Statement of Adjustments

Your real estate lawyer is required to prepare the Deed for the buyer in the manner in which they direct. We will do all the calculations and prepare a statement of adjustments for the sale of your house which will reflect all applicable property taxes, condo fees and any other transitional charges to the date of closing; also known as a statement of adjustments.

  1. Mortgage / Loan Discharges

We will arrange to have your bank send us a payout balance foryour mortgage that is calculated based on your date of closing. We will also arrange for the bank to provide a registered discharge of your mortgage. Once we are in receipt of the Mortgage Discharge we will forward a copy on your behalf to the buyer’s lawyer.

  1. Explaining the Legal Documents to You

A lawyer will personally sit with you to explain in full any documents that you are signing. We will also seek your instructions about how you would like to receive the balance of the funds from your sale and instructions with respect to handing over the keys.

  1. Attending to All Tasks on Day of Closing

On the day of closing we will attend to all the banking on your behalf (receive the purchasers money, pay off your mortgage, deposit your proceeds etc). We will also provide the buyers with the keys per your instructions.

  1. Post-Closing Housekeeping/Paperwork

Following your closing we will send your paperwork for your discharged mortgage to the buyer’s lawyer as promised. We will also provide you with a full reporting letter within 30 days of your closing which will contain any important documentation you will need pertaining to your sale transaction.
